RE: Certificate of Inspection

Dear Sirs,

As I'm sure you're aware, Title 75 Chapter 47 4727b of the PA Statutes explicitly prohibits PENNDOT from issuing a Certificate of Inspection to a vehicle which is not

"...in compliance with the provisions of this chapter including any regulations promulgated by the department."
It appears that correspondence from your office to many State and Local Police Departments has given them the false impression that this Statute has somehow or other been repealed, voided, or overruled. They believe that PENNDOT has authorized Inspection Stations to issue Certificates of Inspection for vehicles which ARE NOT in compliance with all provisions of the Motor Vehicle Code, and that somehow they were given enforcement powers.

They actually believe that an Inspection Station is authorized to issue a Certificate of Inspections for a vehicle in violation of Department Regulations, and that they were authorized to stop the vehicle, even as it drives away from the Inspection Station, and cite if for violating a Department safety sun-screening regulation.

I would appreciate clarification of this issue.

For my own peace of mind and safety, I would like you to confirm that when I allow an official PENNDOT Inspection Station to apply a Certificate of Inspection to my vehicle, it indeed certifies that it is "...in compliance with the provisions of this chapter including any regulations promulgated by the department," as required by the Statute.
