Who's Right? PennDot or some misinformed Police?

Only misinformed police will attempt to cite erroneous 'authorities' like Safety Bulletins, newspaper articles, and New Table Xs.

The Bureau of Motor Vehicles, speaking on behalf of the Secretary of Transportation, states that it is NOT the PA STATUTE, the PA CODE, or the INSPECTION REGULATIONS that prohibit tint, but only . . .

"... the Department's interpretation that FMVSS 205...only allows window tinting that permits 70% or more light to transmit through the window."
They could not point out the particular section of FMVSS205 which they interpret, in contrast to all the Other States, as restricting tint less than 70%;, but at least there's no mention of Safety Bulletins, newspaper articles, or New Table X's...

PennDot confirms that legal tinting does NOT violate . . .

  • The Statute
  • The Code
  • The Inspection Regulations
  • Safety Bulletins, New Table Xs, or newspaper articles.
Their entire argument rests ONLY on

PennDot's Interpretation of FMVSS205.

What about the Law and Burden of Proof?

Of course everyone is free to 'interpret' Safety Standards like FMVSS205 any way they like; even if they cannot point out the sections, and even if all the other States, as well as Auto Manufacturers, disagree with their interpretation.

The question to ask is whether PennDot's Interpretation, promulgated only by Safety Bulletins to Inspection Stations, meets the required Burden of Proof to criminalize tinting clearly permitted by ALL APPLICABLE PA STATUTES AND REGULATIONS.
