Window Tinting Discussion BoardPennsylvania - Rule of Law or Police State? If you've read the information on this site it should be clear that PA Law only prohibits tinting which "prevents a person from seeing or viewing the interior of the vehicle." Here's the Actual LAW, TITLE 75 of PA STATUTES - 4524 (e)(1). Notice that it says that any tint is LEGAL unless it "does not permit a person to see or view the inside..." Only then is it illegal!
Now read the PA ADMINISTRATIVE CODE TITLE 67 - CHAPTER 175.67 (d)(4), written to clarify the laws. It restricts tint only "unless permitted by FMVSS205."
The Federal Motor Vehicle Safety Standard FMVSS No. 205 clearly does not prohibit tint below 70%. Read it! After all, most States require conformance with FMVSS205, but still permit tinting as low as 30%.
And finally, when PENNDOT puts an Inspection Sticker on your vehicle, they certify that it is in compliance with ALL "provisions of this chapter including any regulations promulgated by the department." It would be illegal for them to certify the vehicle if it really violated a law. If police are unable to point out where in the PA STATUTE, the Regulation, or the Federal Safety Standard tint below 70% is prohibited, then they should not illegally detain, threaten, or cite vehicles.
